ACCESS TO INFORMATION
Promotion of Access to Information Act (PAIA)
MVA Tax and Corporate Advisory supports the constitutional right of access
to information in accordance with the Promotion of Access to Information
Act 2 of 2000 (“PAIA”).
1. Access to records
PAIA provides a process through which a person may request access to
records held by a private body where access to those records is required
for the exercise or protection of a right.
A request must relate to an identifiable record. The requester must
provide sufficient information to enable the requested record to be
identified and must explain the right that the requester seeks to
exercise or protect and why access to the record is required for that
purpose.
2. MVA PAIA Manual
MVA Tax and Corporate Advisory maintains a PAIA Manual prepared in
accordance with section 51 of PAIA.
The Manual provides information regarding the categories of records
held by MVA, records that may be available without a formal PAIA request,
applicable legislation, the processing of personal information and the
procedure for requesting access to records.

3. How to submit a PAIA request
A request for access to a record should be submitted using the
prescribed PAIA request form and must contain sufficient information
to enable MVA to identify:
- the requester;
- the record requested;
- the form in which access is required;
- the right the requester seeks to exercise or protect; and
- why the requested record is required for the exercise or protection of that right.
The prescribed request form is available from the Information Regulator.
4. Information Officer
PAIA requests and queries concerning access to records may be directed
to the Information Officer using the contact details above.
5. Fees
A request or access fee may be payable where prescribed by PAIA and
the applicable regulations. Where a fee is applicable, the requester
will be advised accordingly.
6. Grounds for refusing access
Access to a record is not automatic. PAIA contains grounds on which
access to certain records may or must be refused, including where
disclosure would unlawfully affect the privacy, confidentiality,
commercial interests or other legally protected rights of another
person.
7. Information Regulator
The Information Regulator is responsible for monitoring and enforcing
compliance with PAIA and provides the statutory Guide, prescribed forms
and information regarding complaints and access-to-information procedures.
8. Updates
MVA’s PAIA Manual and this page may be updated from time to time to
reflect changes in legislation, the records held by the practice or
regulatory requirements.
